A. Individuals who are qualified and interested in applying for H1B visa for the coming years can use this resource to search for companies within US who are willing to sponsor their H1B visas. Q. What is H1B Visa?
A. The H1B visa is a “speciality occupation” visa which an individual from the field of engineering/medicine /IT /R$D/architecture/law and related professions has to obtain from the visa sponsoring company prior to entering the US in order to work temporarily as a professional in the respective field in the US.
 
Q. Who is qualified to apply for the H1B visa?
A.
  1. A person in the occupation which requires a bachelor’s degree
  2. A foreign professional who has US equivalent of a 4 year’s bachelor’s degree.
  3. A person who may have lesser equivalent degree is also qualified to apply if has relevant number of years’ experience in his field.
  4. Any professional from above categories needs to have a written job offer from a US employer who will pay the professional a salary which is equivalent or more than the “prevailing wage rate” for persons in that occupation and geographic location.
 
Q. For how long is the H1B visa valid?
A. Each fiscal year, the USCIS issues a limited number of H1B visas for qualified candidates. The fiscal year is from Oct 1st to Sept 30.The approved visa is issued for 3 years to begin with and can be extended for maximum duration of total 6 years. If the H1B Visa holder also has an approved labor certification or has filed for I-140 application a year before H1B visa validity expires ,the validity period of visa can be extended in unlimited one year extensions.
 
Q. Can I get a H1B visa for a part-time job?
A. Yes you can get an H1B visa for a part time job if all above “qualifications for applying” for the visa are met.
 
Q. Can I apply for multiple H1B visa applications?
A. Yes, you can apply for multiple H1B visas if all above “qualifications for applying” for the visa are met.
 
Q. When can I apply for H1B Visa?
A. Every year you can apply for H1B through a US employer who is willing to sponsor your visa on or after 1st April .If your petition is approved, you can start working in US based on the approved visa wef 1st Oct of that year.
 
Q. Currently I am on H4 (dependent) visa. Can I apply for H1B?
A. Yes, you can apply for H1B visa if all above “qualifications for applying” for the visa are met.
 
Q. Can I change my current job using the current H1B visa?
A. Yes, you have to apply for H1 visa transfer.
 
Q. I have a Masters Degree for an accredited University in US and I am currently on F1 visa ..Do I still need H1B visa to work for a US employer?
A. Yes, you do.
 
Q. As per the current law, can H1 be extended beyond the 6 year limit?
A. Yes, H-1 extensions in one-year increments can be obtained indefinitely, if the I-140 is pending or approved (or the I-485 is pending) and the green card process has been started a year ago. The green card process includes:
  • Labor Certification process; when the labor certification is officially filed with the local office (SESA); and
  • EB-1 and National Interest Waiver (NIW)cases; when the I-140 is officially filed with USCIS (INS).
 
Q. I am currently on L1 visa for the last 10 months. I would like to know if it is possible to convert from L1 to H1 visa? If it is possible, does one have to leave the country and re-enter with the new stamp and can one start working immediately on filing H1?
A. It is possible if qualifications for applying for H1 are met. If you are maintaining appropriate status as per regulations, you can convert without leaving USA.
 
Q. I am currently a student and I do not have a job right now. When I get a job, can I start working immediately after applying for H1 visa based on receipt notice without waiting for H1 to get approved? Or do I need to wait to join work until my H1 visa is approved?
A. You cannot work legally till you get the approval.
 
Q. Can I hold both F1 and H1 visa together i.e. can I get the H1 and continue to do the study on F1 visa?
A. No –you can hold only one status at a time. But as per the law ,you can go to school on H-1 visa while you work.
 
Q. I am currently on H4 Visa. I have filed for H1 transfer this year. What will my status be if my H1 is rejected?
A. Denial of H-1 does not affect the H-4 visa.
